Under Article 352 of the Constitution of India, an emergency can be declared if the security of any part of India is threatened by war, external aggression or armed rebellion. Article 352 holds the key for National Emergency, provisions of which are taken from Germany or Weimar Constitution. If the President is satisfied that there exists a grave emergency, whether due to war or external aggression or armed rebellion, then he/she can proclaim emergency to that effect. Such an emergency was declared in India in 1962 (China War), 1971 (Pakistan War), and 1975 (declared by Indira Gandhi).
