The 73rd and 74th Amendment Acts have established the StateElection Commission. It says that ‘The superintendence, directionand control of the preparation of the electoral roles for and conductof all the elections to the Gram Panchayat and Zila Panchayat shallbe vested in the State Election Commission consisting of a StateElection Commissioner to be appointed by the Governor. Subject to the provisions of any law made by the Legislature of a State, theconditions of service and tenure of office of the State ElectionCommissioner shall be such as the Governor may by rule determine.’The Commissioner cannot be removed in any manner other thanas a Judge of the High Court until he demits himself or completes histenure. Hence, statement (3) stands incorrect.
