The 44‌th amendment act was passed in the year 1978 by the Morarji Desai government. It eliminated the right to property, which was a fundamental right according to Article 19. This particular amendment made right to property only a legal right. It is to be considered that the 25‌th amendment, 1971 curtailed the fundamental right to property that allowed the government to obtain private property for public use after paying compensation to the owner.
