The 52nd amendment to the Constitution added the Tenth Schedule which laid down the process by which legislators may be disqualified on grounds of defection. It considerably increased the powers of the Speaker/Chairman of the House. On important questions whether a legislator is subject to disqualification under the anti-defection law, the decision making power vests with the Speaker or Chairman of the House, and their decision is considered as final. They can start action against the members under anti-defection law.
