The protection against arrest and detention under Article 22 of the Constitution of India is not available to an enemy alien and to a person detained under a preventive detention law. Article 22 (c) of the Indian Constitution provides for the same. It provides that if a person is arrested or detained under a law providing for preventive detention, then the protection against arrest and detention under Articles 22 (1) and 22 (b) shall not be available.
