Section 375 in the IPC defines what amounts to rape. Rape as per the law is sexual acts viz. Penetration of the penis or any other object, touching vagina of thewoman by mouth, manipulation of any body part of a woman so as to cause penetration when done:-
Against the will of the woman.
Without the consent of the woman or;
With the consent when that woman is under the effect of alcohol or drugs or is of unsound mind or;
After getting her consent putting her under any threat or;
Sexual intercourse with a woman of under 18 years of age.
But the law provides exception that when a man have sexual intercourse with his wife even she has not consented for it would not amount to rape.Provided that his wife is not of age below 15 years. This has often been a matter of debate being termed as marital rape".
