(A) A court can presume that any act constituting offence was committed on the ground of ‘untouch ability’- if such offence is committed in relation to Schedule Caste.Section 12 of the Act provides that if an offence is committed against a member of the Scheduled Caste, the court will presume, unless the contrary is proved, that such act was committed on the ground of untouchability. Under this Act the provisions of Probation of Offenders Act, 1958, has no application in case of a person,who has been alleged to have committed the offence under this Act, is of above the age of 14 years.
