The First Emergency in India was imposed due to theIndia-China war in 1962 .
Jawaharlal Nehru was the Prime minister of India during the 1962 war.
There are three types of emergencies that can be imposed in India. These are:
- National emergency (Art 352)
- State emergency or presidential rule ( Art 356)
- Financial emergency (Art 360)
- A national emergency can be imposed on these following grounds:
- External aggression
- Armed rebellion
- War
- The feature of suspension of fundamental rights during the national emergency was borrowed from the constitution of Germany.
- The emergency provisions were taken from the Government of India act 1935 in the Indian constitution.
- Emergency provisions are defined in Part XVIII of the constitution.
- After the proclamation of a national emergency, all Fundamental rights got suspended, except Art 20 and 21.
