A driver of a tourist bus, while negotiating an unmanned railway crossing at a speed of 30 kmph clashed against a passenger train. Consequently, one of the tourists was killed. On investigation, it was found that the driver could not stop the bus because of a defect in the brakes not known to him. Is he guilty of negligence?
